&lt;p&gt;More than 75 people packed the Haymarket Town Hall last Thursday night as residents, business owners and members of surrounding communities voiced their opinions about a $2.3-million commercial development offer.&lt;br /&gt;
And while the affair was cordial in nature, it did not come without controversy; &lt;strong &gt;Council Member Bob Weir recommended afterward in an open letter to Mayor Pamela Stutz that she consider resigning her office.&lt;/strong&gt;&lt;/p&gt;

 <title>John Cole Resigns</title>

&lt;p&gt;John Cole, who left town back in early February to go overseas for a civilian DOD job, has decided to vacate his position on Town Council as of last Thursday.  &lt;/p&gt;
&lt;p&gt;Why he had originally desired to hold onto his position from half a world away is beyond anyone&#039;s scope of reasoning.  He is going to be gone until at least August, so the right thing to do is to step down.  The Town Charter provides for 6 council members to meet to discuss Town business...not 5 and one overseas.&lt;/p&gt;
&lt;p&gt;The question now becomes, does the Council fill his spot?&lt;/p&gt;

&lt;p&gt;Can&#039;t blame the town for the falling real estate market, but we can blame them for paying loans for property that sat mostly vacant for the last two years until they spent almost $100k to move the Police Dept to one of the old houses.  Will they continue to foot the bill fo&lt;/p&gt;

 <title>Town election this year?</title>

&lt;p&gt;Not surprisingly, there is no information on the Town&#039;s site, yet the clerk who answered the phone confirmed it was this year &#039;in May sometime&#039; but she wasn&#039;t sure of the date.&lt;/p&gt;
&lt;p&gt;We need to get some new blood in there, but if the registration deadline passes, we&#039;ll be stuck with these bozos for another 2 years.&lt;/p&gt;

 <title>Bob Wier &quot;DON&quot;T JOKE WITH ME!&quot;</title>

&lt;p&gt;On December 11, 2007 There was an open forum for people who&#039;s children  would be effected by the new elementary school being built. The county put on a very nice power point presentation and the allowed a open answer session where people who were effected by the change could voice questions ,comments or concerns.&lt;/p&gt;
&lt;p&gt;Mr Weir waited in line and identified himself as Robert Wier then openly said that his child WOULD NOT be effected by any of the four changes proposed that night, yet still voiced his disapproval. The county rep stated that &quot; he should wait tll next year.&quot;&lt;/p&gt;
&lt;p&gt;At which point Mr Wier thn exploded , yelling at the rep and everyone else about the &quot; problems&quot;and DON&#039;T JOKE WITH ME!!! He was then told to remove himself from the platform and was boo&#039;ed and laughed at as he left.&lt;/p&gt;

 <title>Land for sale</title>

&lt;p&gt;So, the Council is thinking of accepting the offer by Mr. Kennedy for about $2.3 million for the Town Center property.  This is about $700,000 less than they turned down from him less than 2 years ago.  WHAT ARE THEY THINKING?&lt;/p&gt;
&lt;p&gt;Last time, they didn&#039;t want his money, because they &quot;were worried about how he was going to finance it&quot;.  Truth be told, they were holding out for more money.  His financing plan would have been fine.  Just look at the corner lot of Jefferson and 55...the Red House.  He bought that lot and turned it into a nice looking parcel with a successful business as a tenant - looks like his financial planning was sound enough for that project.  At the least, it was better than Lewie Bloom&#039;s plans for the 2nd Bloom building.  He still hasn&#039;t found a stable rack of tenants besides his own seafood store.&lt;/p&gt;

 <title>Recall?</title>

&lt;p&gt;I for one am tired of the way this town is being run.  The people in charge are not playing by the rules. They need to answer to the residents for what they are doing.&lt;/p&gt;
&lt;p&gt;Since they will not listen to the residents when they complain, here&#039;s another way:&lt;/p&gt;
&lt;p&gt;Under Virginia law, a petition to remove an elected official must be signed by a number of registered voters equal to at least 10 percent of the votes cast in the election.  The petition would then be filed in Circuit Court, where a judge would determine whether to remove the elected official.  The judge must find evidence of &quot;neglect of duty, misuse of office or incompetence in the performance of duties&quot; that has a material adverse effect on the office in question.&lt;/p&gt;

 <title>Mayor throws away over $1,500!</title>

$650 - Equipment Fee&lt;br /&gt;
$350 or More - Generator (unsure exact amount due to lack of invoice and increased power needed)&lt;/p&gt;

referenced, but they are not up on the VCDL site at this time.  Mike&lt;br /&gt;
has a great deal of fun with a town that is way, way too big for its&lt;br /&gt;
britches:&lt;/p&gt;
&lt;p&gt;-- &lt;/p&gt;
&lt;p&gt;Move over France and England!  It looks like the tiny town of&lt;br /&gt;
Haymarket, **appearing** to lie within Prince William County, VA, has&lt;br /&gt;
broken away from Virginia and is forming it&#039;s own country!  In it&#039;s&lt;br /&gt;
first two actions as a new country, Haymarket has started to act like&lt;br /&gt;
a superpower and make it&#039;s own way in the world.&lt;/p&gt;
&lt;p&gt;As you may recall from a previous VA-Alert, VCDL has taken issue with&lt;br /&gt;
Haymarket&#039;s aggressive police roadblock program (AKA, &quot;DUI&lt;br /&gt;
checkpoints&quot; off of Interstate 66 in northern Virginia) in which VCDL&lt;br /&gt;
Executive Member (EM) Dennis Fusaro was previously detained long&lt;br /&gt;
after he **voluntarily** blew a &quot;0.0&quot; in the police breathalyzer -&lt;br /&gt;
the police then told him he had to leave the checkpoint without his&lt;br /&gt;
gun!  To add insult to injury, the Haymarket police subsequently&lt;br /&gt;
obtained a warrant for Dennis&#039; arrest on a bogus harassment&lt;br /&gt;
accusation - the charge was later dropped in court.  There has been&lt;br /&gt;
little press on this issue, but a regional blogger has picked up the&lt;br /&gt;
story at:&lt;/p&gt;

&lt;p&gt;VCDL operatives have since obtained 2 Haymarket records which are&lt;br /&gt;
very insightful into the minds of those who rule that little town.&lt;/p&gt;
&lt;p&gt;The 1st document is a resolution by the Haymarket Town Council&lt;br /&gt;
**retroactively** appointing 3 police officers who the Haymarket&lt;br /&gt;
Police Chief has been using to enforce laws and run roadblocks for&lt;br /&gt;
some time.  Apparently the council was afraid that a citizen&#039;s lawyer&lt;br /&gt;
might point out to the court that arrests made by improperly sworn&lt;br /&gt;
police officers are invalid  - so the council invented their own&lt;br /&gt;
procedure to pretend these officers were always correctly sworn in.&lt;br /&gt;
In the resolution, council repeatedly recites the legal term &quot;nunc&lt;br /&gt;
pro tunc&quot; as if the term has talismanic properties.&lt;/p&gt;
&lt;p&gt;The term &quot;nunc pro tunc&quot; is normally used in routine divorce matters&lt;br /&gt;
to backdate the divorce in the interest of all parties.  One online&lt;br /&gt;
legal dictionary states that &quot;Nunc pro tunc literally means &#039;now for&lt;br /&gt;
then.&#039;...This phrase is used to express that a thing is done at one&lt;br /&gt;
time which ought to have been performed at another. Leave of court&lt;br /&gt;
must be obtained to do things nunc pro tunc, and this is granted to&lt;br /&gt;
answer the purposes of justice, but ***never to do injustice***.  A&lt;br /&gt;
judgment nunc pro tunc can be entered only when the delay has arisen&lt;br /&gt;
from the act of the court.&quot;&lt;/p&gt;
&lt;p&gt;So Haymarket is now creating new common law for itself by invoking an&lt;br /&gt;
innocuous legal term from family law to cover up the fact that&lt;br /&gt;
un-appointed police officers were enforcing laws?  A Potomac News&lt;br /&gt;

&lt;p&gt;The 2d document  is a proposed detour from the VA freedom of&lt;br /&gt;
Information Act that the Haymarket Council is considering at the&lt;br /&gt;
apparent recommendation of its Town Attorney, John C. Bennett who&lt;br /&gt;
also practices &quot;VA law&quot; in Culpeper County.&lt;/p&gt;
&lt;p&gt;The plain language of the Virginia FOIA at Va. Code  2.2-3700 et seq.&lt;br /&gt;
indicates that citizens need only provide their name and address when&lt;br /&gt;
making FOIA requests, and, that citizen pre-payment can only be&lt;br /&gt;
required if the public body estimates in advance that the reasonable&lt;br /&gt;
costs of searching for and reproducing the records will exceed $200.&lt;br /&gt;
But the new Republic of Haymarket FOIA rules seek, among other&lt;br /&gt;
things, to make citizens provide their phone number and pay in&lt;br /&gt;
advance for routine FOIA requests!&lt;/p&gt;
&lt;p&gt;So there you have it - the Republic of Haymarket is creating new&lt;br /&gt;
common law and new statutes.&lt;/p&gt;
&lt;p&gt;What&#039;s next for the Republic of Haymarket?&lt;/p&gt;
&lt;p&gt;Will Virginians have to present US passports when they exit&lt;br /&gt;
Interstate 66 and encounter Haymarket police roadblocks?&lt;br /&gt;
Will Haymarket currency be required to pay police roadblock fines?&lt;br /&gt;
Will Haymarket seek seat on the UN Security Council?  Will Haymarket&lt;br /&gt;
militarily intervene in the armed conflict between Israel and&lt;br /&gt;
Lebanon&#039;s Hezzbollah?  Only time will tell! &lt;/p&gt;

 <title>Mayor Gives Chief More Money!</title>

&lt;p&gt;This is an email that we uncovered from the accountant telling them &lt;b&gt;NOT&lt;/b&gt; to pay the Chief for leave balances where there is &lt;b&gt;&quot;NO PROOF&quot; &lt;/B&gt;that he actually worked to earn the leave.  * Notice the date.&lt;/p&gt;
