Haymarket Mayor places Website on Alert!

Mayor's Race

What is the Mayor thinking?

Attempted Scare tactic by Mayor of Haymarket and Councilman Bob Weir.

Residents of Haymarket,

I wasn't sure which section this post should fall under. I first
thought it should be located under the "Website" section because it
discusses this site. I then decided to put it under the "Mayor" section
because it is ultimately her decision to send this TRASH out to all of
the residents in the town.

However, it should be under WASTED TAXPAYER MONEY! The town pays per hour for their attorney. I wonder how much of OUR money the Mayor
wasted researching the federal code sections to write all of this about
the website? Do you really care what Title 15 states? I don't!

I wasn't going to mention my personal opinion in this election because I
wanted to have an unbiased website for all residents to post their own
opinions. This Mayor without discussion with many of the other council
members is seriously planning to spend between $10,000 and $20,000 of
OUR money to go to Federal Court over my little website!

DOES THE MAYOR REALLY THINK IT'S WISE TO SPEND HER TIME AND OUR MONEY INVESTIGATING A WEBSITE BECAUSE CITIZENS ARE EXERCISING THEIR RIGHT TO FREE SPEECH AND IN THE PROCESS BEING CRITICAL OF HER PERFORMANCE?

One must ask themselves WHY? Is it really because residents are
confused and think they are on the official town of Haymarket website?
Do you think YOU are on the official town of Haymarket website? I don't!

If this is the mayor's issue and she is worried about residents mistaking
this website for the official Town of Haymarket site, the issue can be
easily solved. We'll just change the name of the site. I have a few
suggestions here:

www.firepamstutz.com- as you know sites like this are very popular for
coaches and politicians alike
www.straighttalkinghaymarket.com- that's what we're doing here
www.thetruthabouthaymarket.com- that's what this site hopes to elicit
www.freespeachonhaymarket.com- again, that's what we're doing here
www.haymarketknuckleheads.com- that's who we're talking about here
www.abetterhaymarket.com- that's what this site hopes to create

If it will save the people of Haymarket money and keep the Mayor focused on the business of the people of Haymarket (which is of course is her job) I'll be happy to change the name of the site to one of these. It's just amazing to me that the Mayor who works for you has spent your time and money and dedicated the entire front page of her newsletter to bringing down a website that does nothing more than encourage free speech. The Mayor needs to remember what's important to her constituents. I really don't think that shutting down this site (or having its name changed) is something that many in the town of Haymarket feel will improve their lot in life.

I really think she and one other council member don't like the fact that
the TRUTH is coming out about their term in office.

Think about this when you vote on May 2nd! Do you think the town should
spend thousands of YOUR dollars on my small site?

Copy Rights to Haymarket Logo

To whom it may concern ie; Anonymous,
I hope you realize that to reprint or use without permission you are infringing on a copy righted logo. I know because My husbands company holds the copy rights for said Logo. We pay the cost of the copyright of this logo Designed by our company. You have now crossed a real legal line here. We will be speaking with legal council about this issue...

Speak Away!

Do what you have to do!

HeySite Owner

You may not currently care about Titles 15 or 17 but I would suggest you start. You may want to read section 512 of Title 17 as amended by the Digital Millenium Copyright Act (DMCA). Many of the provisions of those amendments were made with sites like this in mind, provisions that enable the infringed to take down websites that use protected materials without permissions. First amendment rights and parody do not seem to apply with regard to this farce of a website.

Although I am not an attorney with the Patent Office, I think a review of Title 15 (Patents and Trademarks) would also be prudent. Many of the provisions of that Title apply to passing off for commercial gain.

You might not care about the Federal Statutes, but if you were aware of their contents you would probably not have posted much of what is on this website as their appear to be multiple causes for action, actions under Federal Jurisdiction. (aka Bob Weir)

Because I don't know...

Where does the newsletter indicate that the logo is a registered trademark? Doesn't it have to have a R or C with a circle around it or something like that to indicate if the town bought that logo?

They are too busy

I bet they are too busy sending RX email out to those who had to have an email address to post to this web site to read up on Title 15 and Title 17. Drama is a marketing scheme needed to attract people to this web site.

And, they might be too busy responding/answering to their own messages/mistakes in here to have time to read Title 15 and Title 17.

Abstract if you will.

"This is a summary report of findings from a study of takedown notices under Section 512 of the Digital Millennium Copyright Act.[1] Section 512 grants safe harbor from secondary copyright liability (i.e., the copyright infringement of their end users) to online service providers (OSPs), such as Internet access providers or online search engines. In order to receive the safe harbor, online service providers respond to cease-and-desist letters from copyright complainants by pulling their users' information—web pages, forum postings, blog entries, and the like—off the Internet."

maybe some of us are busy..

Maybe some of us are busy. Living real lives instead of worrying about silly copyright laws. Some of us have social lives.

Silly Laws?

I still don't know where I stand in the upcoming election and I am very concerned about the phrase "Silly Laws"...Laws may not seem appropriate, and may even seem outdated...but to deem them 'silly' and therefore worth ignoring is a dangerous position to take.
Laws we dont agree with need to be changed through due process,i.e; though our elected officials.

I deem..

I deem worrying about copyright issues over the other ongoing issues silly. I may have phrased that wrong. You don't seem to do well in reading comprehension. Take a course. Not everything is literal.

Running scared

Seems like a whole lot of people trying to switch the topic here. ;)
Going to waste time and money to nit pick about a logo while the real issues that are more important get tossed to the side. I as a resident could careless about logos. Im more concerned about why the people who are supposed to be working for the town find the need to lie to the town. Don't you think thats more important then a picture of Haymarket?

color it what you will...

A paid patent is a paid Patent and infringement is just what it is and has legal grounds for action.
No one requested use of such Logo therefore is an infringement.
There is reason for a patent. Yu care so much about law on this website I thought you needed to know to cease and desist use unless permission is requested. This has nothing to do wth town affairs it was and always had a patent on it any other use constitutes infringement.
Look at it however you want...

Is laughing

I am looking at what I want. The funny part is since you all are mad about what gets talked about your going for a logo. I find it hilarious.
