With all the new laws that are getting passed, does anyone know what a citizen would have to do to legally carry a pistol on the outside of their pants, in plain view and not concealed?

I know with a concealled carry permit, you can carry a loaded weapon that is concealled out of view of general public.

Also there is a bill called the "Alaska Carry" that is in the house or senate of Virginia, that will allow a person to keep a concealled weapon in their vehicle.

Open Carry

Open carry is what you are describing...and it is perfectly legal within the Commonwealth. As long as the handgun can be seen and easily identified as such, you are free to put it in a holster and walk around town.

In VA, open carry of a pistol on one's person is perfectly legal...in 95% of the state. You can carry openly just about anywhere (bars, restaurants, parks, etc). If someone asks you to leave, you must comply.

Concealed carry, on the other hand, requires a permit and has limitations as to where you can/cannot carry.

If you go on to the VCDL website, it has a list of gun unfriendly places, such as restraunts and such.

Also you can open carry into a restraunt, but you can get a charge if it is concealed in that same place. Best rule of thumb is to open carry it everywhere you go. If you find a place that you think you should be able to carry but can not, email the website, and it will be corrected, or black listed by them.

And for god's sake, make sure you are legal to carry a firearm before you do it.

As for the vehicle, as long as it is in a case in the back seat or the back of your vehicle such as a SUV or truck, you should be alright. We have enough former policeman on here to let us know if it is wrong or not.

I suggest that everyone should start to carry a pistol on their hip, it is one of the best crime deterrents.

Also, a quick question, is it concealed if it is on your hip in a holster in the car? And what is the distance you have to stay away from a school zone?

the law isn't too clear, but unloaded and inaccessible is the rule of thumb so as to not get a concealed weapon charge. So don't just put it in a case in the back seat or the trunk, as most cops will charge you then.

As for concealed in your car on your hip...if the officer cannot see it in plain site, it's concealed.

School rules just changed with this past General Assembly...can't remember what they decided, but am pretty sure you can drive up to the school to pick up/drop off your kids and have your gun with you.
