Appalachia probe expands beyond election

Excerpts from article below:

An investigation of alleged criminal activity in an Appalachia town election has officially expanded to look at other allegations of government corruption.

Special prosecutor Tim McAfee confirmed Wednesday he will present evidence in the probe to a Wise County grand jury this morning. McAfee hopes the grand jury will return indictments tomorrow.

A county circuit court judge on Friday signed an order confirming that McAfee and assistant special prosecutor Greg Stewart could expand their probe beyond investigation of alleged crimes associated with the May 2004 town council election.

McAfee and Stewart had previously been appointed to investigate the election. County Commonwealth Attorney Chad Dotson removed his office from the probe citing a conflict of interest, because the office also prosecutes criminal cases brought by the town.

According to the order signed Friday by Judge Tammy McElyea, McAfee and Stewart found evidence of "alleged corruption" during their and the Virginia State Police's election investigation.

EVIDENCE FROM SEARCHES

In late January, state police executed search warrants on the Appalachia town hall, the civic center and the police department, along with the homes of Mayor Ben Cooper, police Capt. Ben Surber, Councilman Andy Sharrett and his parents, who both work for the town, and others, seeking evidence in the election probe.

At the police department, he said, state police found what they suspected were prescription pills, marijuana and other drugs lying in desk drawers and filing cabinets. The drugs were not marked or identified as being linked to particular cases, McAfee said.

Officers found what they believe to be a marijuana plant in the desk drawer of Surber, who is currently in charge of the department, the prosecutor said. At this time, officials aren't alleging that there was criminal activity involving the drugs or marijuana plant, he said, "but what was it doing in a desk drawer?"

McAfee called the unsecured storage of drugs in various places "a horrible way to do business."

Investigative findings related to the police department went beyond drugs, according to McAfee.

Appalachia police had conducted a search of a citizen's residence more than a year ago, the prosecutor said. They seized drugs, a large television set and a knife set. One of the police officers had been using the television set at his own house for about a year and a half, according to McAfee.

State police knew about the television before they arrived at the civic center. When they got to the police department, McAfee explained, they called the officer at home and told him to bring the television set to them immediately. The officer complied.

"It's illegal," McAfee said. "Police officers aren't allowed to take other people's property for their own use."

McAfee claims that evidence suggests there was a conspiracy both to get certain people elected to town council and to gain control over the police department so that certain people could gain from it.

I hear that he is taking a bunch of vacation time because he is afraid that a new council won't protect him and he will be out of a job. I guess he was vacationing and couldn't make the meeting this week.

If he was smart, he should just save up all the vacation time, and when they fire him, he can turn it in for a big check.

Or just a suggestion - Why not ask anyone anything you want to know and once you get an answer (from the person), then post it in here. It would make for better reading than your assumption(s).

Incidently, I saw Haymarket's Police Cheif Jim Roop in town Monday, April 3, 2006 in the red Haymarket Crown Vic at the Haymarket Police Station.

Are you assuming that he was both on duty and on vacation during the same day??????? Now, I dunno about the Town Council Meeting on Monday night.

Ask Haymarket's Police Chief Jim Roop. I for one will not say one way or the other, and much like you I do not know, and I could care less. The Police Chief was in Haymarket during the day, Monday, April 3, 2006.

1. "several guns"..Hoffman carried no unusual amount that he doesnt carry every were. As do most officers on and off duty. But unless your an officer I don't suppose you would know that.
And just fyi its not illegal to do so.

2. The article may say he was arrested. But he was never arrested. It's best to do all the research before formulating an opinion.

3. He has worked security for several different functions. None of which were illegal. Gun shows, a poker game, soccer games, Car Auctions, etc etc. The poker game was not founded as any part of a gambling ring. A rich guy had poker games with rich buddies. (some of which were successful business men from Haymarket). This also is not illegal. Unless the house is taking a cut. To which the host/millionaire was not taking a cut nor needed to.

Changing your name on here to hide behind misconstrued opinions. A tip. We can easily tell the same ignorance no matter how many different log in names you use.

And also I believe profitt does have a life. A very well off one. One I quite envy at times. I just love when someone points a finger via the internet and says "get a life". Considering you seem to be on here as much as the rest of us. That doesn't make for much of a life does it? You seem to waste alot if it posting comments. Let's see, from what I am reading in the article, is that this whole thing started back in June of 2005. I think I would love to see the Christmas presents at that home of the officer who was earning the money for christmas

Where in all my postings did you read that I think it is ok for the guy who is a convicted felon to get away with anything? I was just explaining how other charges were dropped for the innocent people who were playing poker. I also said it is up to the court to decide if the game was illegal. I didn't even mention a weapon you idiot! Funny, it seems like someone else gets called an idiot on this board often. I assume you are someone that is already on this board and just logged in under another name to post a slam against me.

You talk about illegal activities in this town. Give it a couple of months. It will all come to light. You will then see how the current council condoned ALL of these activities.

Finally some-one has written some truth in the matter. I totally agree. Benjamin needs to just run his on business and as far as Hoffman goes -- a FELON on the coucil -- that has a VERY bad smell to me.

I've lived in Haymarket Ten Years and have a very high Respect for Pam and for Jim whom I have known since I moved here. Jim has allways been dedicated to this town and all of it's people.

As much as I like to disagree, Hoffman has not been convicted of anything as of yet. It was put on a backburner for whatever time period the judge had said.

So Officer Hoffman is not considered a felon, unless he messes up, and the charges are reinstated

where are you guys getting your information. Hoffman was charged with 2 misdemeanors...not felonies. When in doubt, search the code section.

I think it makes NO difference whether it's a felony or a misdemeanor..police officers shouldn't EVER break the law..especially for profit! there is nothing illegal about a "friendly poker game" but officers KNOW that providing security for a poker game in which the "house" gets a cut is ILLEGAL gambling. We've got to know that our officers will at LEAST uphold the law as well as enforce it!

PS: Hoffman's only charge waiting to be dismissed is a Class 3 misdeamor. Less than a reckless driving ticket. Less than a littering ticket.

CTP, is it true that you recommended to Rahim that Hoffman would be a good employee? Are you really Charlie Profitt, one of Haymarket's past Auxiliary Police Officers? Is it true that you were and probably are still employed by Rahim, the man who was arrested on an illegal weapons and running an illegal gambling establishment in Great Falls where Fairfax Police Officers raided when Hoffman was arrested?

Or are you an undercover Fairfax Police Officer who was assigned to the Rahim case?

Voters want and need to know these things. And they want the truth. I know you have lied about the number of people gambling at Great Falls when it was rated..... "7 of the 25", when everywhere else it is written that "60 people were wagering".
