A Reminder for the Haymarket Police

Two weekends ago, I was driving through downtown Haymarket. Two cops were apparently on duty and parked together in front of the Town Hall. As I turned left onto Old Carolina Road, one of the police cars left the parking lot - and, was talking on a cell phone.

I think the police force for the community of Haymarket needs to be aware that using a cell phone while operating a motor vehicle is now a violation.

Not a Violation

Not that I am one to take up for the local town police. However, using a cell phone while operating a motor vehicle is not a violation nor is it against the law.

The only law that could possibly apply (and it has been in effect since July 1, 2009) would be "texting while driving" under ยง 46.2-1078.1. This law states:

A. It shall be unlawful for any person to operate a moving motor vehicle on the highways in the Commonwealth while using any handheld personal communications device to:

1. Manually enter multiple letters or text in the device as a means of communicating with another person; or

2. Read any email or text message transmitted to the device or stored within the device, provided that this prohibition shall not apply to any name or number stored in the device nor to any caller identification information.

B. The provisions of this section shall not apply to:

1. The operator of any emergency vehicle;

So the police can type, talk, text, and check emails while driving.

When do they work?

I never see them anymore. I was told the little guy who wrote alot of tickets recently left the department.
