Haymarket Refuses Checkpoint Documents!

Once again, the Chief of Police, The Mayor, and Town Council are opening the Town up to a lawsuit. Many people have requested a copy of the DUI Checkpoint plan for the checkpoint that was conducted on April 28, 2006.

This has been the town's official response to all FOIA requests in regards to this topic:

"In response to your FOIA request dated Jun XX, 2006, received by the Town of Haymarket on June XX, 2006, the Town of Haymarket would respond as follows:

A document consisting of five pages will be withheld in its entirety in accordance with the provisions in Section 2.2-3706.7. This document is the operational and tactical procedures relating to DUI checkpoints. The custodian has exercised his discretion not release these records."

Tactical? What are they talking about? If anything, I could see not releasing the document prior to the checkpoint. However, there is no reason whatsoever not to release this document after the checkpoint. As a matter of fact, if someone was ticketed or charged with a crime that night, they would have a LEGAL right to review the document. Then this would be made a public document by means of being entered into the court records. Where is Haymarket's thought process on these matters?

I have checked with the Fairfax County, Prince William County, and Virginia State Police. They have all sent copies of there checkpoint operational plans to others I know. What is Haymarket hiding?

I believe this website was started to bring the truth to the citizens. So once again, a document that the town has been hiding will be released!






I would like to ask any police officers, police administrators, or attorneys to review this document and let us know what is wrong with it. I am sure there are some legal issues since the Chief of Police is refusing to release it.

According to this, the officers were briefed since 28 April 2005. The Chief trust these guys to operate a check point but not to double check his reports. You would think if this was an offical document someone would have proofed read this. I guess when you are busy covering your a** you miss the small things.

Well, leave it to the Town Atty to improperly interpret the FOIA rules again. And leave it to the Council to stand behind both him and the Police Chief and not respond to the residents inquiries.

The atty led the Council down the wrong path the last time and the Town settled a lawsuit because of it. Of course, they've yet to make that public knowledge. Again, keeping things from the public that they don't want to tarnish their false image.
