3. VCDL hits Haymarket with a FOIA request!

I fired off a Freedom of Information Act letter to Haymarket last
week and should be hearing back within a few days. Many thanks to EM
Mike Stollenwerk for drawing up the FOIA letter for me.

Here are the four things that Haymarket was asked to document:

1. Any ordinance, policy, or procedure establishing or regulating
police "checkpoints" in which persons or vehicles are detained for
inspection on public highways.

2. Any ordinance, policy or procedure establishing or regulating a
police protocol wherein citizens' firearms possessed at checkpoints
or in routine traffic stops are seized or otherwise retained by the
police for subsequent investigation.

3. A tabulation, description, or summary of firearms seized at
checkpoints in calendar year 2006; if no tabulation, description, or
summary exists, please provide the individual records pertaining to
each seizure, or, create such a tabulation, description, or summary
for me.

4. Any ordinance, policy or procedure establishing or regulating a
police protocol wherein citizens' firearms possessed at checkpoints
or in routine traffic stops are required by the police to be placed
in locked trunks prior to the citizen departing the checkpoint of
routine traffic stop.

How much you want to bet?

I bet the Police Department returns nothing in response to this FOIA. They will claim that there is no established policy or procedure for their checkpoints.

Chief...beware....VA court of Appeals states that you shall have an established policy or procedure to conduct checking details. However, we all know that you have been known to not worry about a little thing called the law in the past.

Town Council, if the Chief of Police does not produce an established policy or procedure in response to this FOIA, he should be terminated! He has once again opened the town up to a huge liability. All citizens charged and/or arrested during the checkpoint detail where done so in violation of their 4th amendment rights. It only takes 3 people to form a class action lawsuit.

I believe that it would be very easy for a group of people to prove that the town is culpable in their liability by continuously keeping the Chief employed without disciplining him for all his inactions and screw ups in the past. Lets look back on the how much liability he has opened the town up to:

Sexual Harrassment

Employees working as Police Officers for 2+ years without Policy Manuals (If anything happened on the street, the town would have been liable because the Officers never receieved a manual!) -**This is Police Supervision 101**

No proper evidence lockers

False Vehicle Calibrations (Another Class Action Lawsuit waiting to happen against the town!) **If someone wants exact details - let me know**

Improper/Illegal Checkpoints the past 3 years (except for the one that Atty Dupray required a checking procedure for. All DUI's had to be dropped to reckless on previous checkpoints.)

Several People have the combination to his DEA approved Narcotics Safe with is against DEA policies. (Used for his drug dog which there is now no line item for in the next years budget. Thank God the Council got smart on that waste of money for someone's pet!)

And those are just off the top of my head. I will let you know if I think of others!
