Former auxiliary officer sues Haymarket

After nearly a year of trying times for Haymarket, the town is facing a new challenge -- a lawsuit.

Former town auxiliary police officer Charlie Proffitt filed a lawsuit Friday in Circuit Court against the town and Mayor Pam Stutz.

The lawsuit stems from a Freedom of Information Act request Proffitt submitted to the town via e-mail on April 12.

Proffitt wanted a copy of the lease between the town and the last tenant of the old post office building, also known as The Red Rooster.

He also requested a list of all lease payments and any other fees paid to the town from the same lessee, in addition to any correspondence between the town and lessee.

Proffitt did not receive any response from the town's attorney until April 21 via facsimile, according to the lawsuit.

The Act requires a response from the request's recipient within five work days.

In an e-mail to Proffitt from Stutz dated April 27, Stutz notes that Proffitt's request was not filed by the town until April 13.

If that were the case, the town's response would have been within the five work day period.

However, Proffitt's original request was stamped April 12, a town clerk confirmed Friday.

Proffitt said he doesn't think he'll get the information until after Election Day. He thinks that was done on purpose.

Proffitt said he initially wanted the information because he had heard Stutz, who owned The Red Rooster, had fallen behind on lease payments during her ownership and while serving as a council member.

He said he wanted to see if that rumor was true.

"If I got the information [that it was true], I would probably have let the other candidates know," he said. "I think if the mayor is going to accept money from the town as a paid council member and owe the town money, I don't think it's fiscally responsible."

Stutz could not be reached at her workplace or her home for comment Friday.

Ah baloney, Charlie! ACTUALLY YAWN,HO HUM!

Incidentally, I believe and seriously doubt that the subject person of your nosey and selfish behavior owes the Town of Haymarket of Virginia any rent; and she earned her Town Hall of Haymarket money the old fashioned way - she mangages quite well as an official with the Town Hall of Haymarket, VA, and does an outstanding job at it. And, She worked in the Red Rooster and, incidently, those of us who stopped by to say hello and or, to buy, or to browse appreciate her business ethics and efforts!

Now, as for your research, for example, I know that in some of the Middle East Countries the government lobs off an ear or hand, or some body part for certain behavior, and there is probably some punishment for "getting behind in lease payments" over in Pakistan or Afghanistan. And, I have reason to believe that your former or present employer -Rahim- has schooled you on business practices in Pakistan. But, by golly, Charlie, wake up, this is "'America'" and around here we tolerate getting behind in lease payments. And, I am sure that if the payments had continued to fall behind that the Town Council would have taken further action. However, knowing that none was taken, the matter was closed way before you spent YOUR MONEY on the FOIA!!!!!!!

Charlie you need to understand that, when something like "getting behind in lease payments" happens to one of the honest and hard workingest people in Haymarket, VA, as well as respected, a little tolerance and respect is earned not given or taken! So, Charlie, as far as a lot of people are concerned about your unearthing some fiancial records............say Charlie, do you have a fireplace? Well here is a suggestion - use the paper that the FOIA report is printed on to start your kindling next Winter, or just file it under File 13.

I personally understand that you and your kind have cost the taxpayers enough with your childish and immature attempts to over through the decision made last July 2005; need I say more!

In a couple of days I plan to post about 50 stories of companies - large and small - who have had financial difficulties, to include Bill Gates, Mr. Crapo, Dodge boys, and Toby Keith.

In your post above, you stated, "And, I am sure that if the payments had continued to fall behind that the Town Council would have taken further action." Well you were wrong! See below.

Some Facts about our current mayor:

1. In the months that were saved electonically, she was behind in her rent in excess of 12 days 12 separate times. I listed in excess of 12 days because this is when the LEASE states she should be charged an extra $40 for being late after the 1st of the month.

2. The Mayor never paid a late fee that she should have. I guess she figured that since she was on the town council, she didn't have to pay the fees as stated in the lease. The Town Council did not vote on this. She just ignored the lease! Therefore according to my calculations, she still owes the town $480!

3. At one point the Mayor was 10 months behind in her rent!!! See invoice 8/1/2004. And you have the audacity to say that someone on council would have taken action?!?! I guess they only do that when you are 1 year behind in your payments!

4. Her lease was to continue until March 1st 2005. The council let her out of the lease early. I can only assume that is due to the fact that they realized that they weren't going to be receiving any more payments so why bother.

5. Most Importantly! I have to agree with Proffit in the article. The Mayor was taking money monthly for while serving on the council and FAILING to pay the town the money that it was due for her rent. She could have at least signed those payments directly over to the town if she was having financial troubles. (It appears she did that the last month.)

Residents - This person was accepting money from the town government at the same time she owned that same government money. THIS IS WHAT SHE TRIED TO HIDE FROM THE ABOVE FOIA and cost the town a lawsuit!

Is this the Mayor you want running your town?

Ok, so now Charlie (aka Watchdog) is a bill collector.

So what! Now you expect the taxpayers to pay for a FOIA that the residents did not ask for. You ordered the FOIA, you pay for it! I doubt that a FOIA is in the 2006 or 2007 Town Of Haymarket Budget. So hoss out your own personal checkbook cause whoever you owe for that FOIA is expecting full payment forthwith!

And - ABSOLUTELY, I DID NOT ASK FOR A FOIA; once again you have lied!

The FOIA wouldn't have cost the taxpayers any money had the Mayor responded and not tried to conceal the truth or put it off until after the election!

Balance to the Town of Haymarket says $0.00. I am certain that the taxpayers have no interest in paying for you ordering a FOIA!

Like I said, Charlie, you have no knowledge of any medicine that I may or may not be taking. Therefore, you lied when you said for me to be sure I take my medicine today.

There is a balance

If you read the lease, she did not adhere to the terms. So there is a balance, and proof to back that up. Or is there a conspiracy to cover it up. Is Sheila involved? What a circle you run with. GlenP you need to see what the definition of truth is, because you live in fairy land, and you are the king fairy. And by the way I have seen you get prescriptions, you do take medication, Mr. Proffitt is correct about you needing it. Now we know the truth about Ms. Jarboe, she is just as bad as Stutz.

Let me know if you would like me to have the webmaster post all of the back and forth emails to the Mayor about my FOIA request prior to the suit being filed so that you can see where I tried to handle this prior to litigation. I doubt you want that though. You never really want the truth. You kinda enjoy your alternate reality.

Mayors debt

I guess if Charlie pays for his FOIA request you will pay off Pam Stutz's debt to the town. His request is within 30 days, how old is her debt? I think she owes interest. Can she afford that.

The history of Bill Gates and his rise to the be one of, if not the richest man on Earth has not always been one of getting rich without problems and setbacks. I post this as an example to show that business is not always lucrative at first and as I have written before ‘tolerance is allowed’ and it should be. Its takes time to develop a business.

- Charlie, in case you do not understand why I posted the above, its because within the short story it speaks of the reason why ‘Taf-o-Data’ failed; it was not because of its capability, but because of the bad publicity! In Microsoft’s early years, Gates could have borrowed money from his parents, but he chose not to.

I guess the post above is to show how qualified Bill Gates is to run the town of Haymarket. I think so to. Please everyone since he is not on the ballot, please write him in, he will get the job done. Heck he is endorsed by GlenP, that goes a long way. Idiot.

I wouldn't mind a Bill Gates for mayor. So long as he's not as long winded and redundant as mr. glenp.

I am knew to this site, but I have quickly noticed a thin line between the ones that support the town and police department and those that do not. When does it stop? Everyone has a right to speak their opinion, but after awhile I think personal feeling's start to cloud the light of the real problems and issues. I don't take sides on here and like I mentioned before on another post, I agree with many posts and disagree with others. I have nothing against anyone and I find it easier to review this site with an open mind when I have nothing to gain or lose by whatever is posted.

it is not so much a matter

it is not so much a matter of personal feelings, but a matter of the mountain of lies and cover-ups that there is public proof of and people choose to ignore it and allow the same group of people to continue to run our town. these lawsuits that are filed against the town because of the unprofessional and crooked leadership that we call our mayor and council, are paid for by the residents. it might make some people bitter.
